TERMS AND CONDITIONS

By using any portion of BendBroadband's services the user agrees to be bound in totality and without exception to all of the terms and conditions presented regarding and applicable to this service, without exception.

DEVELOPMENTAL PRODUCT
BendBroadband is a product currently in its development stage. It is subject to change and modification in appearance, functionality, and reliability without notice. Any content entered may be subject to deletion or dysfunction without notice to the user. BendBroadband makes no representation or guarantee regarding the functionality, reliability, or continuance of service. This product is being offered free to the public for the sole benefit of BendBroadband Systems, Inc. in the testing of the features, scalability, and functionality of the product. Usage of the product by the public indicates acceptance of the risks outlined above.

MATURE CONTENT
BendBroadband provides its services to the general public. Users agree not to post items of mature content nor use the contact vehicles of BendBroadband to discuss or solicit behavior of a mature nature.

ILLEGAL CONTENT AND CONDUCT
No user shall submit, post, use, or make available for download or transfer any material or file to which they do not own legal right to do so. No user shall submit, post, use, or make available for download or transfer any material or file which would be considered illegal in its nature, or appearance. No user shall submit, post, use, or make available for download or transfer any material or file which would call for, or incite behavior that in its conduct would be considered illegal in its execution.

CONTACT GUIDELINES
BendBroadband's services include functions which provide opportunity to directly contact and exchange information and conversation between users. All users agree to not use these services to arrange for direct contact or personal exchange between adults and minors. Additionally all users agree to not use these functions in a manner which would result in a minor gaining exposure to mature content or topical discussion.

E-COMMERCE GUIDELINES
BendBroadband's Auction and Store modules are provided as a vehicle for transactions between users. BendBroadband does not take possession of any materials, nor is in any way involved in the negotiation, consummation, or execution of any contract or sales agreement. All users recognize that all complaints or legal actions can be directed only at the contracting parties and BendBroadband shall be released and held harmless from any issues of performance, warranty, or fraud.

HOLD HARMLESS
User's of BendBroadband products shall agree to hold BendBroadband Systems harmless from liability or damages for any and all activities conducted by themselves or other users. BendBroadband Systems' products are offered for the usage of the general public, and BendBroadband shall not be held responsible or liable for their content or conduct.

PRIVACY
BendBroadband shall not disseminate to any third party for any reason any information of a personal nature. BendBroadband will provide any and all information and records of usage and contact to any law enforcement agency which they might request them as a part of an investigation. BendBroadband reserves the right to use personal information collected in order for BendBroadband to contact individual users regarding services offered by BendBroadband, or a BendBroadband partner.

CHANGES AND DELETIONS
BendBroadband reserves the right to deny or discontinue service to any user at BendBroadband's discretion without cause or notice. All user's understand and acknowledge that content is subject to deletion and loss and BendBroadband is not responsible for any real, subsequent, or consequential damages of such discontinuance or deletion.

The Terms and Conditions presented herein are subject to change without notice. The user agrees to keep abreast of any and all
changes to the terms and conditions and shall be bound thereby as they are implemented.
